PRESS RELEASE - FLACH FILM issues a writ against GOOGLE for copyright infringement - 23/11/2006
Jean-François LEPETIT (FLACH FILM), producer of the documentary film "Le monde selon Bush" (The World According to Bush), directed by William KAREL, is issuing a writ against the companies GOOGLE FRANCE and GOOGLE INC for copyright infringement and parasitism, before the Paris Commercial Court.
While the Producer has organized the legal distribution of this film on video and VOD by entrusting it to the Editions Montparnasse platform, GOOGLE, through its site GOOGLE VIDEO FRANCE, provides access to the film in its entirety and at no cost, thereby contravening the clauses of the Code de la Propriété Intellectuelle (Intellectual Property Code) relating to copyright and annex rights.
The film is accessible on the site through a simple click, as a stream or a download and, according to GOOGLE's own sources, has had in excess of 43,000 hits in a very short period.
FLACH FILM feels that the indispensable legal supply of films via Internet cannot develop as long as this kind of infringement and parasitism.
FLACH FILM, represented by Maitre Olivier CHATEL, intends to hold GOOGLE responsible, considering that the latter has not acted as a simple host but as a fully responsible publisher.
This is why FLACH FILM requests the court to sentence GOOGLE to provide compensation for the loss resulting from these illegal acts.
